Nothing is more constant than the change - new from the ECJ to the transfer of operations (with checklist)
Once again, the ECJ - this time due to a submission of the LAG Düsseldorf - intervened in the national case law with its judgment of 12.2.09 ("Klarenberg", C -466/07, call -no. 091023). In view of this, the BAG will have to adapt its case law in the integration cases, in particular it will not be able to continue its previous case law on "identity -destroying integration".
