The Christmas season is just around the corner and despite the crisis, companies will pay their Arbn this year because they want to reward the services of their ArbN or have to pay against the background of a current decision by the BAG from March 18, 2009 (10 AZR 281/08, call-no. 091946; see also Mareck, AA 09, 117). So far, claims that have arisen due to an operational exercise have been changed or repealed by an opposite company exercise. The BAG said goodbye to its principles for the opposite company exercise.
