In many companies, special payments, gratifications etc. are made to employees at the end of the year. However, these are mostly misleading and non -transparent. This often raises the question of whether special payments can be shortened, withheld or reserved or backed by the ArbN. Based on the latest decision by the BAG on special payments (28.3.07, 10 AZR 66/06, call-no. 072386), the basic requirements for employment contract regulations and the possibilities of repayment are explained.
