Federal Employment Agency publishes updated "technical instructions" on the Employee Contribution Act - Establishment from October 15, 2024

The Federal Employment Agency has published the updated technical instructions (FW AÜG) to the AÜG, which have been in place since October 15, 2024. They replace the technical instructions that have been in force since 01.08.2019.

Through the technical instructions, the Federal Employment Agency provides information on how it interprets the regulations of the AÜG. The test teams and the Teams of the Processing of the Federal Employment Agency are based on these requirements for their audits.

The change history can be found on pages 2 and 3 of the current technical instructions.

Among other things, the specifications for proof of credit ratings have increased.

The old technical instructions from August 1, 2019 required proof of liquid funds, among other things, by submitting a credit confirmation or the credible proof of the presence of liquid funds (e.g. presentation of a current account statement). In the current technical instructions, the Federal Employment Agency has increased the requirements for the financial performance of the personnel service providers.

 The technical instructions can be found in Section 3.1.3 (page 61):

 "In any case, it must be ensured that the distributor is able to meet his obligations to pay wages, to pay social security contributions and taxes. As a rule, liquid funds of EUR 3,000.00 per agency worker (previously: EUR 2,000.00), but at least EUR 15,000.00 (previously: 10,000.00 EUR) are required."
