The first judgments and new ones from the Federal Ministry of Labor
The minimum wage law has been in effect since January 1 of this year. The first judgments of labor courts on various aspects of the Minimum Wage Act (MILOG) are already available. The BVerfG dismissed three constitutional complaints. The BAG has made a fundamental judgment on continued payment and the holiday fee. In addition, on July 29, 2015, the Federal Ministry of Labor issued a new regulation on the recording obligations and announced clarifications on certain areas. In the following, five judgments of the labor courts, a judgment of the BAG and the decisions of the BVerfG are discussed and their effects explained in practice, and the new regulation and announcements of the Federal Ministry of Labor are presented.
