After a long back and forth, the Nibelgeber Protection Act (HinschG) came into force quickly on July 2, 2023. The law obliges companies with more than 250 employees directly to set up a reference provider protection for so -called whistleblower. This applies to companies with more than 50 employees from December 17, 2023. In the event of violations, there are sensitive fines. So you have to work now.
We present the now applicable legal obligations and their addressees.
The protected group of people and the comprehensive violations are presented, with the main focus on the confidentiality requirement and the protection of the pointer. Internal and external reporting routes are presented and practical instructions for the introduction and operation of a whistle system are given. In addition, we will shed light on the labor law requirements in the introduction of a whistle system and explain what special challenges exist when entering a notification.
